The multinational enterprise can either adopt cross-border merge and acquisitions (M&A) or export to enter the market. This paper shows that the stricter IPR protection of the host country leads to a higher incentive for the multinational enterprise to choose cross-border M&A. On the contrary, the multinational enterprise has a higher incentive to adopt export if the IPR protection is weaker.
In addition, when the production technology of a multinational enterprise is superior (or the production technology of the firm in host country is inferior), there is a higher incentive for the multinational enterprise to enter the host country by cross-border M&A.
As the market size is larger, the multinational enterprise has a higher incentive to enter the host country by export. Finally, when the market size is large or the host country firms are not sufficiently inefficient, the host country will set a strict IPR policy to attract the multinational enterprise adopting cross-border M&A to enter the market.
